TERMS AND CONDITIONS
DEFINITIONS Unless otherwise expressly provided in other specific provisions of the terms listed below have in these Conditions of Sale, the meaning that is attributed to them in the following meanings: “Business Day” or “Days” refers to the days when Our offices are open for normal business (generally every day from 9 am to 12:30 and from 14:30 to 18 hours excluding Saturdays, Sundays, national holidays and local) “Force Majeure Event” include situations resulting (directly or indirectly) from any strike, lockout, fire, flood, proven impossible to obtain products, materials or services, breakdowns, delays by suppliers or couriers, laws or government regulations or any other cause or event beyond our control. The above is provided only as an example. There are other events that can be of a force majeure.
OBJECT These General Terms and Conditions are for the purchase of products POSITIVE PEOPLE WE carried out remotely via computer network at “www.wepositive.com” belonging to Marini Fashion Ltd., based in ZI Colleranesco, Giulianova (TE). These purchases are reserved for customers direct users. Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and, as regards the protection of confidentiality, will be submitted to the rules of the Legislative Decree n. 196/03.
ACCEPTANCE OF ORDER / CONCLUSION OF THE CONTRACT When the customer places an order online for products that has inserted into the cart, agrees to buy them at the price and terms set out in these Conditions of Sale. POSITIVE PEOPLE WE will not accept orders: – if the material at the time of the order, not in stock (if the material is not available, it will be possible to add it to the cart) and / or – if the card issuer credit the customer does not confirm the payment. POSITIVE PEOPLE WE reserves the right to refuse the order at its discretion.
COMMITMENTS OF THE CUSTOMER These Conditions of Sale must be examined online by customers before sending their orders. The submission of the order implies their full knowledge and full acceptance. The customer agrees and undertakes, once the purchase process online, print and keep these general conditions of sale, already examined and accepted during the purchase process, in order to fully satisfy the conditions of that Articles. 3 and 4 of Legislative Decree. N. 185/1999.
PRICES All prices in this site include VAT. Prices on this site are the selling prices currently in force. In case the price of the ordered goods to be reported by WE POSITIVE PEOPLE in an openly discordant, the order can be canceled at any time by WE POSITIVE PEOPLE or the customer, provided before sending the goods, and you can reorder products to the correct selling price.
PAYMENTS The payment of the products purchased and the shipping costs will be paid by the customer when the order by using one of the available credit cards indicated online, via Paypal or COD. POSITIVE PEOPLE WE is not responsible for any fraudulent or illegal use that may be made by a third party credit card upon payment of the products purchased.
RIGHT OF WITHDRAWAL To exercise this right, the customer must contact the service indicated on the site, follow the instructions that the operator will provide and send to WE POSITIVE PEOPLE a notice to that effect within 7 working days of receipt of goods. Such notice shall be sent by registered letter with acknowledgment of receipt or by telegram or fax sent within the said period of 7 days and followed by a confirmation sent by registered letter with acknowledgment of receipt within 48 hours. Once such notice of withdrawal, POSITIVE PEOPLE WE will quickly inform the customer details on how to return the goods.
IMPORTANT: As the only burden, and if the error does not result from a fact attributable to WE POSITIVE PEOPLE the customer must pay the cost of returning goods. The goods must be returned intact and in its original packaging, complete with all its parts and without having suffered any damage. Upon his arrival at the warehouse, the goods will be examined and, if damaged or tampered with, the withdrawal can not be exercised POSITIVE PEOPLE WE will refund the customer the full amount already paid within the statutory time limits. Reimbursement will be made by crediting the amount due on the credit card used by the customer to purchase refunded. The Buyer shall promptly provide to WE POSITIVE PEOPLE any available information necessary for proper and urges the refund procedure.
COMPLAINTS Any complaint must be addressed directly to WE POSITIVE PEOPLE, after contacting customer service or e-mail to the address indicated on the dedicated website. POSITIVE PEOPLE WE will respond to complaints within three working days.
LAW AND JURISDICTION The sales contract between the customer and WE POSITIVE PEOPLE is concluded in Italy and governed by Italian law. Any dispute concerning the validity, interpretation or execution of this contract the territorial jurisdiction hole Teramo.
DELIVERY BUYING ONLINE purchases online are shipped and delivered in max 7 days throughout the country by courier BARTOLINI, Monday through Friday, from 9.00 to 18.00. All orders are processed and shipped as soon as possible, following the authorization of the payment of credit card and clearly a result of the availability of stock.
RETURN POLICY If you are dissatisfied with the product you have purchased on our website, we are happy to refund the price paid or to send another replacement product. If you want to change your product with a different model, please within the package that you are going to return, please include the code number of the new model along with a copy of the receipt of your order online. Rights The user can, at any time and without formalities, exercise your rights under Art. 7 of the Privacy Code referred to in Legislative Decree. N. 196/2003, and thus obtain confirmation of the existence of data concerning him, to know the content and origin, verify its accuracy or request its integration or updating, rectification, cancellation, anonymization or blocking of data in violation of the law, and oppose any case, for legitimate reasons, to their treatment, addressing Marini Fashion Ltd., at the above address.
